By accessing or using Harper ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use our Service.

2. Service Description

Harper provides Facebook attribution tracking and analytics services for e-commerce businesses. Our services include:

  • Click tracking from Facebook advertisements
  • Conversion tracking and attribution
  • Analytics dashboard and reporting
  • Integration with e-commerce platforms (Shopify, WooCommerce)
  • Facebook Conversion API (CAPI) integration
  • Multi-touch attribution modeling

3. Account Registration

To use Harper, you must:

  • Be at least 18 years old
  • Provide accurate and complete registration information
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorized access
  • Be responsible for all activities under your account

4. Acceptable Use Policy

You agree NOT to:

  • ❌ Use the Service for illegal purposes
  • ❌ Attempt to gain unauthorized access to our systems
  • ❌ Reverse engineer or decompile our software
  • ❌ Share your account with others
  • ❌ Use the Service to track users without proper consent
  • ❌ Scrape or harvest data from our platform

  • ❌ Generate artificial clicks or fraudulent conversions

5. Pricing and Payment

5.1 Subscription Plans: Harper offers monthly and annual subscription plans based on conversion volume.

5.2 Billing: You will be charged in advance on a recurring basis (monthly or annually). All fees are non-refundable except as required by law or stated in our Refund Policy.

5.3 Price Changes: We may change pricing with 30 days notice. Continued use after price changes constitutes acceptance.

5.4 Failed Payments: If payment fails, we may suspend your account after 7 days. Data will be retained for 30 days before permanent deletion.

6. Data Accuracy and Limitations

We strive for accurate tracking but cannot guarantee 100% accuracy due to:

  • Browser privacy settings and ad blockers
  • Cookie deletion by users
  • iOS tracking restrictions
  • Network issues or downtime
  • Third-party platform limitations

Harper is provided "AS IS" without warranties of any kind. We do not guarantee specific attribution rates or results.

7. Intellectual Property

7.1 Our IP: All Harper software, trademarks, logos, and content are owned by us. You may not copy, modify, or create derivative works.

7.2 Your Data: You retain ownership of your data. By using our Service, you grant us a license to process your data solely for providing the Service.

8. Privacy and Data Protection

Your use of Harper is also governed by our Privacy Policy. You are responsible for complying with all applicable privacy laws (GDPR, CCPA, etc.) when using our tracking services.

9. Termination

9.1 By You: You may cancel your subscription at any time. Your access will continue until the end of your billing period.

9.2 By Us: We may suspend or terminate your account if you violate these Terms, fail to pay, or engage in fraudulent activity. No refunds will be provided for terminations due to violations.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • Harper is provided "AS IS" without warranties
  • We are not liable for lost profits, data loss, or business interruption
  • Our total liability is limited to fees paid in the last 12 months
  • We are not responsible for third-party actions (Facebook, Shopify, etc.)

11. Indemnification

You agree to indemnify and hold Harper harmless from any claims arising from: (a) your use of the Service, (b) your violation of these Terms, (c) your violation of any rights of others, or (d) your violation of applicable laws.

12. Changes to Terms

We may modify these Terms at any time. Material changes will be notified via email 30 days in advance. Your continued use after changes constitutes acceptance.

13. Governing Law

These Terms are governed by the laws of the United States. Any disputes will be resolved in the courts of [Your Jurisdiction]. You waive any objections to venue.
